The 130th Constitution Amendment Bill moved in the parliament stipulating that if any minister, including chief ministers and the Prime Minister, is arrested and held in custody for 30 straight days, for an offence punishable by five years or more in jail, he or she must resign or lose office. Apparently, this looks like a crusade against corruption. But the underbelly of this proposed legislation is to hand over unrestricted power to the ruling establishment at the Centre to frame any minister of the opposition camp by weaponizing the central investigation agencies like the CBI, ED and NIA. We vehemently oppose this draconian Bill overturning the well-established principle of ‘innocent till proved guilty’, violating The Representation of the People Act, 1951 of the Constitution and demand that this legislation be withdrawn lock, stock and barrel.
